What is the Fair Credit Reporting Act (FCRA)?

The FCRA is a federal law that regulates how consumer reporting agencies can use your credit information. It is a complex piece of legislation that was passed to help protect consumers’ personal credit information by restricting who has access to that information and also how it can be used. Credit Reporting Agencies may not provide your credit report to anyone without your express permission.

FCRA Violations

Due to the size and complexity of the law, there are a number ways to violate the FCRA. Recently, a number of companies have come under fire for potential FCRA violations during the hiring process. According to the FCRA, an employer may not obtain a background check by a third party on a prospective employee unless certain criteria are met. The employer must make “a clear and conspicuous disclosure in writing” to the employee or prospective employee that a background check may be obtained by the employer for employment purposes. This disclosure must be a stand-alone document and cannot contain any other extraneous language. The employee must sign the document and authorize the background check to be run. Also, if an employer is making a hiring decision based on a background check done by a consumer reporting agency, the applicant should have the right to receive a copy of the report or be allowed explain its contents.

FCRA Consumer Rights

As mentioned above, the FCRA is a large piece of legislation that covers a wide variety of rights for the consumer. Some of the features designed to protect consumers include: the right to request and receive a copy of an up-to-date report; limiting access to your report; getting your consent before an employer can access your report; disputing inaccurate information and having it investigated; and having outdated information deleted.
